1How to choose the best method of purchase between your personal name or a Croatian Company?

  • There are certain restrictions that apply to foreign nationals purchasing property in Croatia but they have been significantly relaxed and foreigners can now own property in Croatia without ministerial approval. The only requirement is that your country has a reciprocal land ownership agreement with Croatia. All EU member countries are automatically included.
  • Should for whatever reason it not be possible for you to buy personally then you will have to purchase the property via a Croatian limited liability company. It is not a difficult or expensive process and we assist you with it.
  • The Croatian Company will be set up with you as the nominated shareholder. No restrictions apply to Croatian Companies in terms of land ownership.

2How to select your finishing materials?

A detailed list of the materials and colours will be provided. From this you will select your preferred combinations and sign the specification sheet. Should you want a material that is not specified we will investigate the viability of the choice and communicate the change in price and delivery time.

3The pre-contract.

All parties will sign the pre-contract and the deposit will be payable. We will provide the contract for you and your attorney’s scrutiny and comments. The pre contract records all parties’ obligations and rights toward and against each other.

4Progress payments and certificates.

The payment process and percentages are agreed in the pre-contract. Once the milestones have been achieved the supervising engineer submits progress certificates after which payment becomes due.

Payment terms are as follows:

  • 20% deposit on signature of the contract.
  • 30% on completion of the rough works defined as structure and roof.
  • 30% on completion of the window installation, electrical and water services.
  • 20% on completion of the apartment prior to handing over the keys.

5The final payment.

On completion of the apartment a final certificate will be issued by the supervising engineer. Once the final payment has been received the final sales contract which is an extension of the pre-contract will be signed and the property will transferred into your name and the keys handed over.

6The snag list.

After occupation you will have a period as defined in the sales contract to notify us of any defects or variances in the quality of the apartment. These will be rectified within the specified period and final completion will be achieved.

Other issues to be aware of:

  • As per Croatian law a 5% tax is levied on the sale of all property payable by the buyer after registration. This tax is not included in the price. We will assist you with this process to make it as easy as possible.
  • All other costs for the transaction are included in the price.
  • On signature of the final sales agreement you will be obliged to join an owners association and contribute toward the maintenance of the building and gardens. The costs will be communicated to you annually and they will be minimum necessary to maintain the quality of the building. The first year’s costs will be EUR 30.00 per month.
